After US Supreme Court SCOTUS decision Equal Employment Opportunity Commission EEOC is not a jurisdictional requirement, employers cannot wait to raise failure to exhaust administrative remedies in litigation & should plead this affirmative defense & move for dismissal of case at 1st opportunity.
